Unconsented episiotomies and other procedures during labour are commonly reported by women in several countries, and often highlighted in birth activism. Yet, forced caesarean sections aside, the ethics of consent during labour has received little attention. Focusing on episiotomies, this paper addresses whether and how consent in labour should be obtained. We briefly review the rationale for informed consent, distinguishing its intrinsic and instrumental relevance for respecting autonomy. We also emphasise two non-explicit ways of giving consent: implied and opt-out consent. (...) We then discuss challenges and opportunities for obtaining consent in labour and birth, given its unique position in medicine.We argue that consent for procedures in labour is always necessary, but this consent does not always have to be fully informed or explicit. We recommend an individualised approach where the antenatal period is used to exchange information and explore values and preferences with respect to the relevant procedures. Explicit consent should always be sought at the point of intervening, unless women antenatally insist otherwise. We caution against implied consent. However, if a woman does not give a conclusive response during labour and the stakes are high, care providers can move to clearly communicated opt-out consent. Our discussion is focused on episiotomies, but also provides a useful starting point for addressing the ethics of consent for other procedures during labour, as well as general time-critical medical procedures. We read commentaries on our feature article ‘The ethics of consent during labour and birth: episiotomies’1 with gratitude and interest. Nearly all commenting authors agree that consent for in-labour procedures is necessary and ideally given at the point of intervening. Both Shalowitz & Ralston and Stirrat note that this is already required by professional statements and guidelines in the USA2 and UK3, respectively, but also note that practice does not yet conform. The Americans authors helpfully emphasise the importance of multilevel (...) institutional measures for closing this gap, including consent policies and reporting mechanisms, as well as ongoing education.2 The UK writer seconds the role for education within wider shared decision-making and informed choice approaches, and generously commends our paper for close study by all maternity care providers. Others add a cautionary note. Lee applauds all our recommendations, but notes our proposals cannot fully secure autonomy because of, among others, epistemic injustice and other power differentials.4 Kumar-Hazard and Dahlen worry that opt-out consent is equal to substitute decision-making; weakens women’s rights; and is open to abuse.5 Nelson and Clough object to our willlingness to work within a flawed conceptual framework, which ought to be challenged.6 We agree that there are limits to what our proposal can do. It cannot rectify unequal distributions of epistemic credibilities, either in general or in any particular interaction. This paper is based on the Isaac and Tamara Deutscher Memorial-Prize Lecture given at SOAS in London, on 27 November 2009. It claims that Marxism remains built around a critique of political economy but lacks a parallel critique of international relations. IR naturalises the organisation of inter-state relations along lines comparable to the naturalisation of the capitalist economy by economics. The paper argues that the disciplinary organisation of Western academia is part of the class-discipline in society at large. It was (...) triggered by the abstraction of economics from the field of the broader social sciences. IR, in turn, was codified in the slipstream of Woodrow Wilson’s response to the Russian Revolution that followed on from the US-intervention in World-War I. The discipline was built around a founding myth of global liberalism and national self-determination. It served, among other things, to disqualify the claims of the theory of imperialism on disciplinary grounds, and its initial connections with Western hegemony, capital, and the national-security state remain in place today. Distinguishing modes of foreign relations, and specifying the occupation of space, protection, and exchange for tribal and empire/nomad foreign relations, as well as sovereign equality and global governance, on the other hand make it possible to understand the rise and continuing hegemony of the West in its own right, rather than as a superstructure of the transnationalisation of capital. Abstract This essay argues that one way of understanding Gramsci today is as an organic intellectual of a class of managerial cadre which develops in advanced capitalism. With the growth of monopolistic structures and a deepening state role in capitalist society, a separate class of mediating functionaries emerges, entrusted with managerial tasks in running the economy and the state. The problems of conquering power from the perspective of this ?new middle class? that concerned Gramsci, were also those of the neo?Machiavellian (...) thinkers, Mosca, Michels, Pareto and Sorel around the turn of the twentieth century. From opposed political angles, they and Gramsci shared the concern with occupying the centre ground and mediate the extremes in a complex society. This issue considers the ethics of a healthcare provider intervening into a patient’s genitalia, whether by means of cutting or surgery or by ‘mere’ touching/examination. Authors argue that the permissibility of such actions in the absence of a relevant medical emergency does not primarily turn on third-party judgments of expected levels of physical harm versus benefit, or on related notions such as extensiveness or invasiveness; rather, it turns on the patient’s own consent. To bolster this argument, attention is drawn to (...) the status of the genitals as ‘intimate’ anatomy—a status that is not fully erased by being in a medical context. In this editorial, we draw on the work of Talia Mae Bettcher on ‘intimate agency’ to explore why unconsented interventions into the genitalia may constitute a distinctive sort of personal violation compared to unconsented contact with various other parts of the human body. In their feature article, Marit van der Pijl and colleagues1 argue it is unethical for healthcare providers to perform unconsented episiotomies on persons in labour. In particular, they suggest that, outside of certain rare emergencies in which, for example, the person giving birth is incapacitated1 and the procedure cannot be delayed until consent becomes possible without introducing a significant risk of serious harm (call these ‘medically necessary’2 procedures), ‘presumed consent’ is the incorrect standard to apply. Instead, they stress that, especially when a proposed intervention involves a person’s genital, sexual or reproductive organs, the need to obtain their explicit consent in advance of proceeding must be honoured. As the authors note, the broader social significance of our genitalia—widely regarded as ‘private’ anatomy—is not erased by being in a medical context (see also 2–4). IntroductionYounger age at diagnosis is a risk factor for poor health-related quality of life in long-term breast cancer survivors. However, few studies have specifically addressed HRQOL in young adults with breast cancer, nor have early changes in HRQOL been fully characterized.MethodsEligible female patients with breast cancer were identified through our local cancer center. To establish HRQOL, patients completed the Functional Assessment of Cancer Therapy-Breast around diagnosis and 12 months later. Sociodemographic factors, genetic susceptibility to cancer, tumor- and treatment-related factors, and (...) comorbidities were abstracted from medical records and the local oncology registry. Mixed-effects models were used to identify changes in FACT-B scores during the first year of treatment and to determine whether any demographic/treatment-related factors modulated changes in scores.ResultsHealth-related quality of life in young patients with breast cancer was within normal limits at baseline, with a FACT-B overall well-being score of 108.5. Participants reported slight improvements over a 12-month period: FACT-B overall well-being scores increased 6.6 points, functional well-being improved 3.0 points, emotional well-being improved 1.9 points, and physical well-being improved 1.5 points, on average. Participants with anxiety/depression at baseline reported greater improvements in FACT-B overall well-being and functional well-being than participants who did not have anxiety/depression at baseline. Marital status, reconstructive surgery, and baseline clinical staging were also significantly associated with changes in aspects of HRQOL, although their impact on change was relatively minimal.ConclusionYoung women with breast cancer do not report HRQOL concerns during the first year of treatment. Improvements in HRQOL during the first year of treatment may be attributable to a sense of relief that the cancer is being treated, which, in the short run, may outweigh the negative late effects of treatment. In this article, I examine the relation between Bateson and Guattari’s ecological thoughts: two thinkers whose ecological ideas at first sight have a lot in common. In order to show the difference between the thoughts of both thinkers, I will take my clue from Guattari’s remark that he parts ways with Bateson on the role of context. Explaining the role of context in both authors will allow me to show how Guattari’s thought implies both an endorsement and a critique of (...) cybernetics, and, specifically, promoting a machinic rather than cybernetic ecology. This article investigates how companies make sense of CSR. It is based on an explorative comparative case study of 18 companies in the Netherlands using background information, interviews and annual reports. Initially, the sensemaking process of CSR is guided and coordinated by change agents who are specifically appointed to explore the implementation of CSR in their company. These change agents initiate the CSR process within their own organisations. The meaning they develop stems from their personal and organisational values and frames (...) of reference. By attuning the vocabulary of CSR to the language of their colleagues, they aim to gain support for this undertaking in their organisation. This sensemaking procedure can be divided into pragmatic, external, procedural, policy‐oriented and value‐driven processes. The capability of an organisation to embed CSR is the result of trial and error, personal preferences and the use of language by the change agent that fits the (dynamic) situation at hand. Qualitative Coalitional Games are a variant of coalitional games in which an agent's desires are represented as goals that are either satisfied or unsatisfied, and each choice available to a coalition is a set of goals, which would be jointly satisfied if the coalition made that choice. A coalition in a QCG will typically form in order to bring about a set of goals that will satisfy all members of the coalition. Our goal in this paper is to develop and (...) study logics for reasoning about QCGs. We begin by introducing a logic for reasoning about “static” QCGs, where participants play a single game, and we then introduce and study Temporal QCGs , i.e., games in which a sequence of QCGs is played. In order to represent and reason about such games, we introduce a linear time temporal logic of QCGs, called ℒ. We give a complete axiomatisation of ℒ, use it to investigate the properties of TQCGs, identify its expressive power, establish its complexity, characterise classes of TQGCs with formulas from our logical language, and use it to formulate several solution concepts for TQCGs. We investigated how the perception of being dissimilar to others at work relates to employees’ felt inclusion, distinguishing between surface-level and deep-level dissimilarity. In addition, we tested the indirect relationships between surface-level and deep-level dissimilarity and work-related outcomes, through social inclusion. Furthermore, we tested the moderating role of a climate for inclusion in the relationship between perceived dissimilarity and felt inclusion. We collected survey data from 891 employees of a public service organization. An ANOVA showed that felt inclusion was lower (...) for individuals who perceived themselves as deep-level dissimilar compared to individuals who perceived themselves as similar, while felt inclusion did not differ among individuals who perceived themselves as surface-level similar or dissimilar. Furthermore, a moderated mediation analysis showed a negative conditional indirect relationship between deep-level dissimilarity and work-related outcomes through felt inclusion. Interestingly, while the moderation analysis showed that a positive climate for inclusion buffered the negative relationship between deep-level dissimilarity and felt inclusion, it also positively related to feelings of inclusion among all employees, regardless of their (dis)similarity. This research significantly improves our understanding of how perceived dissimilarity affects employees by distinguishing between surface-level and deep-level dissimilarity and by demonstrating the importance of a climate for inclusion. It then balances this with an analysis of how far the current legal paradigm grants group rights to privacy and data protection, and discusses possible routes to addressing these problems. Finding meaning in our lives is a central tenet to the human experience and a core contributor to mental health. Individuals tend to actively seek the sources of meaning in their lives or consciously enact efforts to create or “craft” meaning in different life domains. These overall “Life Crafting” behaviors refer to the conscious efforts individuals exert to create meaning in their lives through cognitively framing how they view life, seeking social support systems to manage life challenges, and actively seeking (...) challenges to facilitate personal growth. Specifically, these behaviors are actioned to better align life goals, personal needs, values, and capabilities. However, no psychological assessment instrument currently exists to measure overall life crafting. As such, the purpose of this paper was twofold: to conceptualize life crafting and to develop, validate and evaluate a robust measure of overall life crafting. A mixed-method, multi-study research design was employed. First, nine participants were interviewed to determine the methods or techniques used to craft meaningful life experiences. These methods/techniques were used as indicators to create an initial item pool which was then reviewed by a panel of experts to ensure face validity. Second, in Study 1, the factorial structure of the instrument was explored by gathering data from a convenience sample, with the results showing support for a three-factor structure of life crafting, consisting of cognitive crafting, seeking social support, and seeking challenges. Finally, in Study 2, the aim was to confirm the factorial structure of the Life Crafting scale and to determine its level of internal consistency, partial measurement invariance across genders, and criterion validity [meaning in life, mental health, work engagement, and job burnout ]. The results supported a second-order factorial model of Life Crafting, which comprised of three first-order factors. Therefore, the Life Crafting Scale can be used as a valid and reliable instrument to measure- and track the effectiveness of life crafting interventions. (shrink)

Two decades of research on euthanasia in the Netherlands have resulted into clear insights in the frequency and characteristics of euthanasia and other medical end-of-life decisions in the Netherlands. These empirical studies have contributed to the quality of the public debate, and to the regulating and public control of euthanasia and physician-assisted suicide. No slippery slope seems to have occurred. Physicians seem to adhere to the criteria for due care in the large majority of cases. Further, it has been shown (...) that the majority of physicians think that the euthanasia Act has improved their legal certainty and contributes to the carefulness of life-terminating acts. In 2005, eighty percent of the euthanasia cases were reported to the review committees. Thus, the transparency envisaged by the Act still does not extend to all cases. Unreported cases almost all involve the use of opioids, and are not considered to be euthanasia by physicians. More education and debate is needed to disentangle in these situations which acts should be regarded as euthanasia and which should not. Medical end-of-life decision-making is a crucial part of end-of-life care. It should therefore be given continuous attention in health care policy and medical training. Systematic periodic research is crucial for enhancing our understanding of end-of-life care in modern medicine, in which the pursuit of a good quality of dying is nowadays widely recognized as an important goal, in addition to the traditional goals such as curing diseases and prolonging life. Although agreement on the positive sign of the relationship between corporate social and financial performance is observed in the literature, the mechanisms that constitute this relationship are not yet well-known. We address this issue by extending management’s stakeholder theory by adding insights from psychology’s prospect decision theory and sociology’s resource dependence theory. Empirically, we analyze an extensive panel dataset, including information on disaggregated measures of social performance for the S&P 500 in the 1997–2002 period. It is common to posit a clear opposition between the values served by property systems and the value of the environment. To give the environment its due, this view holds, the role of private property needs to be limited. Support for this has been said to be found in Locke’s famous ‘enough and as good’ proviso. This article shows that this opposition is mistaken, and corrects the implied reading of Locke’s proviso. In reality, there is no opposition between property and (...) the environment. This article reviews the debate on ‘intersectionality’ as the dominant approach in gender studies, with an emphasis on the politics of representation. The debate on intersectionality officially began in the late 1980s, though the approach can be traced back to the institutionalization of women's studies in the 1970s and the feminist movement of the 1960s. Black and lesbian feminists have long advocated hyphenated identities to be the backbone of feminist thought. But in recent years, intersectionality has sustained criticism from numerous (...) angles within gender studies, ranging from feminist philosophy to applied political research. This article will use the theorization of ‘interference’ as a searchlight to produce an overview of this interdisciplinary debate, culminating in our affirmative answer to the question: should we move from intersectionality to interference? Our answer is based on onto-epistemological reflections, i.e., reflections in which being and knowing are always already entangled. -/- . (shrink)

Although the change of beliefs in the face of new information has been widely studied with some success, the revision of other mental states has received little attention from the theoretical perspective. In particular, intentions are widely recognised as being a key attitude for rational agents, and while several formal theories of intention have been proposed in the literature, the logic of intention revision has been hardly considered. There are several reasons for this: perhaps most importantly, intentions are very closely (...) connected with other mental states—in particular, beliefs about the future and the abilities of the agent. So, we cannot study them in isolation. We must consider the interplay between intention revision and the revision of other mental states, which complicates the picture considerably. In this paper, we present some first steps towards a theory of intention revision. We develop a simple model of an agent’s mental states, and define intention revision operators. Using this model, we develop a logic of intention dynamics, and then investigate some of its properties. (shrink)

Since it was first proposed by Moses, Shoham, and Tennenholtz, the social laws paradigm has proved to be one of the most compelling approaches to the offline coordination of multiagent systems. In this paper, we make four key contributions to the theory and practice of social laws in multiagent systems. First, we show that the Alternating-time Temporal Logic (atl) of Alur, Henzinger, and Kupferman provides an elegant and powerful framework within which to express and understand social laws for multiagent systems. Second, we show that the effectiveness, feasibility, and synthesis problems for social laws may naturally be framed as atl model checking problems, and that as a consequence, existing atl model checkers may be applied to these problems. Third, we show that the complexity of the feasibility problem in our framework is no more complex in the general case than that of the corresponding problem in the Shoham–Tennenholtz framework (it is np-complete). Finally, we show how our basic framework can easily be extended to permit social laws in which constraints on the legality or otherwise of some action may be explicitly required. While having a breast reconstruction, women have certain expectations about their future breasted bodies. The aim of this paper is to describe and analyze these expectations in the process of reconstruction. By applying a qualitative, phenomenological study within a longitudinal research design, this paper acknowledges the temporarily complex, contextualized, embodied, and subjective nature of the phenomenon of expectations. The analysis identified expectations regarding three different aspects of women’s embodiment: their gazed body, their capable/practical body, and their felt body. After reconstruction, (...) these women try to reconfigure—adjust, level or retrospectively rewrite—their expectations. Further, some women face what apparently arrives totally unexpected, namely a strange feeling breast or a failed reconstruction. The development of these women’s expectations can be understood as an active, continuously evolving, difficult and sometimes impossible dynamic of expecting the surprise that is a breast reconstruction. Within this dynamic, women formulate and reconfigure—by definition—unrealistic expectations and validate and try to achieve unexpected futures. We suggest that medical professionals can facilitate this dynamic in various ways. (shrink)

Vers la fin, probablement, du vie siècle de notre ère, David a composé un Commentaire à l’Isagoge de Porphyre comprenant un proème substantiel, lui-même précédé de très longs Prolégomènes à la philosophie (soixante-dix-neuf pages dans les CAG). Contrairement aux leçons préliminaires d’Ammonius qui précédaient le Commentaire de celui-ci à l’Isagoge, les Prolégomènes de David semblent former un tout autonome, sans relation évidente avec le Commentaire qui suit. Cet article a pour but de montrer que David a pourtant tissé des liens (...) solides entre son exégèse de l’Isagoge et les Prolégomènes à la philosophie. Ces liens, principalement noués dans le proème du Commentaire, sont de nature diverse. La première partie de l’article montre ainsi que les Prolégomènes préfigurent le Commentaire sous l’aspect de plusieurs concepts : la philosophie comme connaissance de l’universel ; l’homonymie ; les cinq « voix » ; la notion de « pur concept ». Tandis que la deuxième partie montre que certains principes structurels et méthodologiques du Commentaire à l’Isagoge, en particulier les « méthodes dialectiques », refluent sur la forme des Prolégomènes. En étudiant ces liens – conceptuels, d’abord, méthodologiques, ensuite –, l’article apporte des éléments d’interprétation originaux sur les Prolégomènes de David, en soulignant le profit qu’on tire à les lire à la lumière du Commentaire qui suivra. Despite its uniform appearance, the cerebellar cortex is highly heterogeneous in terms of structure, genetics and physiology. Purkinje cells (PCs), the principal and sole output neurons of the cerebellar cortex, can be categorized into multiple populations that differentially express molecular markers and display distinctive physiological features. Such features include action potential rate, but also their propensity for synaptic and intrinsic plasticity. However, the precise molecular and genetic factors that correlate with the differential physiological properties of PCs remain elusive. In this (...) article, we provide a detailed overview of the cellular mechanisms that regulate PC activity and plasticity. In the present study, we explore how reading habits influence the scanning and the construction of mental models in spatial reasoning. For instance, when participants are given a problem like A is to the left of B; B is to the left of C, what is the relation between A and C? They are assumed to construct the model: A B C. If reading habits influence the scanning process, then readers of French should inspect models from left to right, whereas (...) readers of Arabic should inspect them from right to left. The prediction following this analysis is that readers of French should be more inclined to produce “left” conclusions, whereas readers of Arabic should be more inclined to produce “right” conclusions. Furthermore, one may expect that readers of French show a greater ease in constructing models following a left-to-right direction than models following a right-to-left direction, whereas an opposite pattern might be expected for readers of Arabic. We tested these predictions in two experiments involving French and Yemeni participants. Experiment 1 investigated the formulation of conclusions from spatial premises, and Experiment 2, which was based on non-linguistic stimuli, examined the time required to construct mental models from left to right and from right to left. Our results show clear differences between the two groups. As expected, the French sample showed a strong left-to-right bias, but the Yemeni sample did not show the reverse bias. Results are discussed in terms of cultural influences and universal mechanisms. (shrink)

Heidegger has often been considered as the proponent of the end of metaphysics in the post-Hegelian philosophy, due to his persistent attempts to overcome the onto-theological framework of traditional metaphysics. Yet, this dismissal of metaphysical, theological, and religious motives is deeply ambiguous since new forms of metaphysical and religious experience re-emerge in his philosophical works. Heidegger shares this ambiguous relation to the notions of faith and religion with authors such as Nietzsche and Wittgenstein whose works are also marked by a (...) critique of metaphysics and by a characteristic rethinking of the role of faith and religion. In fact, all three still remain, among other things, reference points for contemporary philosophical debates relating to the phenomenon of religion and faith. Rethinking Faith explores how the phenomena of religion and faith are present in the works of Heidegger, Nietzsche, and Wittgenstein, and how these phenomena are brought into play in their discussion of the classical metaphysical motives they criticize. In this short introduction, the guest editors present the main themes of the special issue.

Results of two survey studies are presented. It is shown that attitudes of the public about "technology in general" are not stable and can easily be affected by how the subject is introduced. Eight areas of technology are compared on the basis of empirical relations in attitudinal judgments, in attribute ratings, in self- assigned importance weights of attributes, and in importance of reference groups and persons. On the basis of similarities in these four kinds of judgments, three clusters of technology (...) areas were identified: a cluster of modern reproductive technologies, an information cluster containing automation, computer, and communication technologies, and a cluster containing nuclear energy and military technology. The attitude toward "technology in general" can not be considered as an aggregation of attitudes toward these areas of technology: The relations between general attitude and specific attitudes are only moderate to negligible.
